Copyright is Dead

It has come to my attention that noncommercial copying of digital music recordings may not be an infringement under Title 17 of the U.S. Code, "Copyrights." I apologize for any confusion I may have caused or any mistaken impression I may have given.

You might want to check out section 1008 of the Audio Home Recording Act :

No action may be brought under this title alleging infringement of copyright based on the manufacture, importation, or distribution of a digital audio recording device, a digital audio recording medium, an analog recording device, or an analog recording medium, or based on the noncommercial use by a consumer of such a device or medium for making digital musical recordings or analog musical recordings.

The senate report on the act specifically cites making copies for family members as non-commercial uses, and thus not an infringement.

While I agree that if the music is under commercial copyright it may be appropriate to pursue legal action, I think it’s outrageously arrogant to assume that the music was commercial to begin with. All music I listen to is freely redistributable. It’s not impossible or even unrealistic to avoid commercial music altogether.

The humour, which apparently you missed, is that the RIAA's charge towards more punishing copyright has made a lot of headway because of corporate-interest-friendly Republicans, (but not by any means singularly so, the Dems have plenty of blame to take,) of which, incase you're reeeally under-informed, Bush is (more or less) one.

This also misses the fact that sites like iTunes which are heavily approved of by the RIAA not only give you the ability to purchase music, but to create mix CDs. A recent upgrade allows access to DRM free music for $0.30 more a song.

Hopefully, Mitch's clients don't pay for legal stupidity like this.

Well I liked the post. Damm some of these comments are so rude.

And I empathize with the humor.
And yes, there is no proof of definitive copyright violation, and the fine is insane. But that is also part of the point? After all many of these lawsuits (Or THREATS of lawsuits) and damages have been just a ludicrouse.

(I saw an article where parts of the recording industry were claiming lost revenues due to on-line piracy of music in France...in excess of the GNP of France!?)

*shrug* So if a single mother of 3 can get a letter demanding thousands of dollars in fines (or face trial) - because her 8 year old /might/ have downloaded a song (well someone did as they own a PC). Why can't the first twins at least be /asked/ if there mix CD is legal?

Nobody here seems to get it. They're sending the president's daughters a letter claiming damages of almost 2 million dollars.

For a present they gave him for Father's Day [lame or not, it's a gift, it's the spirit of the thing].

So, they're trying, and succeeding, to embarrass the president. They are embarrassing a man who can point at them and say to a guy in a black suit with black sunglasses, a white shirt and a black tie [not to mention the shoes]: "That man is an enemy combatant". Think about that, they are embarrassing a man who literally has the power to make them disappear without the right to habeas corpus, without legal recourse, without any means of defending themselves, for as long as the president wants. Merely at his behest.

This is the classic, textbook definition of fucking with the wrong marine.

I think it is a wonderful letter and should be vigorously pursued. Quite frankly nothing will happen in copyright law until a senator or other person in office is sued for something their family did that everyone else is doing (i.e. making mix tapes) - trying to get more attention of the asinine copyright laws and EULA will take something like this happening. I wish the RIAA would sue them, even if they have a legal copy or used PD songs (like thats going to happen!) it will still highlight the issue.

This is not someone that honestly thinks the presidents daughters should be sued. (You may have heard of this kind of humor called sarcasm).
This is about how completely absurd the RIAA's continuous and plentiful lawsuits are. They sue people for this sort of thing all the time! But of course they would never sue the presidents daughters it would be absurd.

The difference is people sharing music over the Internet with millions of others and two daughters giving a legal copy of some music to their dad. This is the classic straw man argument. Create a false analogy and claim victory when you "Put it to em" The eight year old did not make a copy of a CD and give it to his mom, he downloaded a song and violated the song writers copyright, thus causing him to lose his car because he was depending on the royalty from that song to make the payment which was three months late because of so many people are downloading his songs through a peer-to-peer network and not buying his new CD which he maxed out his credit cards to make...

If this is getting you exercised you should know that Bush was photographed with an iPod about two years ago, the playlist was visible and had about 5 Beatles' songs in view. The problem? At the time the only way to get a Beatles' song on an iPod was to rip it "illegally." So really the RIAA should go after Bush 43 first.

Most people seem to not know anything about this.
First off, Bush ripping a Beatles' CD to his iPod is not illegal, since he had already (presumably) purchased the music on a CD.
Second, assuming his daughters had already purchased the tracks that they burned onto the CD, they were allowed to create the CD. HOWEVER, they were not allowed to distribute the "mix CD", for profit or not.

I'm sorry to say this, but I spent 2 years in federal prison because I infringed upon copyrights just like they did and it was absolute a stated fact in the court case that it was 100% for personal non-commercial use. No profit was ever made, but I still did time. It's just as illegal and I did the time to prove it.

I'm not even going to address those of you who thought that
a) the whole thing was an excuse to bash the President (as if anyone needed MORE material)- let me just say that while satire may not be dead, a lot of your brains appear to be; or
b) that the RIAA is actually suing the Bush twins (because you obviously can't read anyway, so there's no reason to believe you'll comprehend my post.

I will address those of you who brought up the Senate report on whether distributing copies is a violation, though.

1) A Congressional report is not law. A court may observe its findings when deliberating, but is not bound to do so.

Also, regardless of whether copying protected material for personal use is legal or not, the RIAA claims it is illegal .

"At the Thomas trial in Minnesota, Sony BMG's chief of litigation, Jennifer Pariser, testified that "when an individual makes a copy of a song for himself, I suppose we can say he stole a song." Copying a song you bought is "a nice way of saying 'steals just one copy,' " she said."
